အပိုဒ် ၅၃၂:

English

Characteristics of Giving

Section 521: “Giving” refers to an agreement in which one person, the “giver,” voluntarily transfers their property to another person, the “recipient,” who accepts the property.

Section 522: A gift can be made by either releasing the recipient from a debt or by paying off a debt that the recipient owes.

Section 523: The gift is deemed complete upon the transfer of the given property.

Section 524: In cases where the right given is based on a written document, if the document is not handed over to the recipient or if the debtor of the right is not notified, the gift is considered incomplete.

Section 525: If the gifted property, when bought or sold, requires a written document and registration with an official, the gift is complete only after the document is prepared and registered with an official. In such cases, the gift is complete without the need for physical delivery.

Section 526: If the gift or a promise to give has been documented and registered with an official, and the giver does not deliver the property to the recipient, the recipient has the right to demand the property or its value but cannot claim any further compensation.

Section 527: If the giver has committed to a periodic payment, the obligation ends upon the death of either the giver or the recipient unless the intention shown in the original agreement states otherwise.

Section 528: If the gifted property is encumbered with a debt and the recipient fails to pay it, the giver may, under the conditions specified in reciprocal cancellation rights, request the return of the property to the extent necessary to pay the debt. However, this right to reclaim is void if a third party has a claim to demand payment for the encumbrance.

Section 529: If the value of the gifted property is insufficient to cover the debt, the recipient is only required to pay up to the value of the property.

Section 530: If the gift comes with an encumbrance, the giver is liable for defects or rights infringements on the property, similar to a seller’s liability, but limited to the amount of the encumbrance.

Section 531: The giver may reclaim the gift due to the recipient’s ungrateful conduct in the following cases:

If the recipient has inflicted serious criminal harm on the giver;
If the recipient has severely damaged the giver’s reputation or defamed them;
If the recipient refuses to provide necessary life support to the giver during times of need, despite having the ability to do so.
Section 532: The giver’s heirs may reclaim a gift if the recipient intentionally and unlawfully kills the giver or prevents the giver from reclaiming the gift. If the giver has already filed a lawsuit, the heirs may continue the legal proceedings.

Section 533: If the giver has forgiven the recipient’s ungrateful conduct or if six months have passed since the event came to the attention of the person entitled to reclaim the gift, the right to reclaim is forfeited. Additionally, no lawsuits may be filed more than ten years after such an event.

Section 534: When a gift is reclaimed, the property should be returned according to the provisions in the Civil Code regarding unjust enrichment.

Section 535: The following gifts cannot be reclaimed due to ungrateful conduct:

Gifts given purely as compensation;
Gifts with encumbrances;
Gifts given out of moral duty;
Gifts given in connection with marriage.
Section 536: Gifts intended to take effect upon the giver’s death are subject to the laws governing inheritance and wills.
