Overview of Property Relations Between Husband and Wife Under Thai Law
When a man and a woman decide to live together and register their marriage in accordance with the law, their relationship is not limited only to social or emotional dimensions, but also extends to property matters. In order to regulate and ensure fairness in the management of property that each party had before marriage and that is acquired jointly during marriage, Thai law clearly sets out a framework for property relations, dividing property into two main categories:
- Personal property (Sin Suan Tua) – owned exclusively by one spouse; and
- Marital property (Sin Somros) – jointly owned by both spouses.
This classification of property is a fundamental basis for determining rights, duties, and limitations in the management of property, so as to create clarity and prevent disputes that may arise in the future.
1.0 Prenuptial Agreement: Setting the Framework for Property Arrangements in Advance
A prenuptial agreement is a legal instrument that allows future spouses to agree in advance on the conditions governing their property relations, which may differ from the general statutory provisions. The main purpose of this type of agreement is to create clarity and set a framework for property management that aligns with the intentions of both parties. It becomes binding once the parties have registered their marriage in accordance with the law.
1.1 Principles and Conditions of a Prenuptial Agreement
The basic principles of prenuptial agreements are laid down in Section 1465 of the Civil and Commercial Code (CCC), which provides that if the spouses do not make a special agreement concerning property before marriage, their property relations will be governed by the provisions in Chapter IV on property of husband and wife.
However, the law also sets limitations on the content of prenuptial agreements, as follows:
- Must not be contrary to public order or good morals: Any clause that is contrary to public order or good morals is void (has no legal effect). For example, a clause stating that in case of divorce, all property shall belong solely to the wife and the husband shall receive no share in any marital property may be considered unfair and unenforceable (Supreme Court Judgment No. 195/2465). In addition, a prenuptial agreement is limited strictly to property matters. If it contains clauses unrelated to property—such as a clause stating that if the husband goes out with another woman, it shall automatically be a ground for divorce—that clause is void.
- Prohibition on choosing foreign law: A prenuptial agreement may not stipulate that the law of another country shall govern property matters. This is because Thai family law is drafted in accordance with Thai social customs. If this rule is violated, that part of the agreement is void.
For a prenuptial agreement to be legally valid, Section 1466 of the CCC prescribes two possible forms:
- The agreement must be recorded in the marriage register at the time of marriage registration; or
- It must be made in writing, signed by both spouses and at least two witnesses, attached to the marriage register, and noted in the marriage register that such agreement is attached.
If the spouses do not comply with the required legal form, the prenuptial agreement will be void, and the general legal rules concerning personal property and marital property will apply instead.
1.2 Modification and Effects on Third Parties
Once the spouses have registered their marriage, the prenuptial agreement becomes a binding agreement and cannot be easily modified or revoked. Under Section 1467 of the CCC, any modification or revocation of the agreement requires permission from the court.
As for its effects on third parties, Section 1468 of the CCC protects third parties acting in good faith: the provisions of a prenuptial agreement shall not prejudice the rights of third parties who have entered into a juristic act in good faith, regardless of whether the agreement is later modified by court order or not.
Case study – Supreme Court Judgment No. 1082/2504:
The wife had land and a house as her own property before marriage and had made a prenuptial agreement that the husband would have no involvement with her property. Later, she allowed the husband to sign the investigation form for the issuance of the title deed in his own name. The husband then mortgaged the land and used the money to buy a car for their joint business. The Supreme Court held that the mortgagee, who in good faith believed the land belonged to the husband, was protected; therefore, the mortgage was valid and binding on the wife as well.
In summary, a prenuptial agreement is an arrangement that must be carefully drawn up and executed in accordance with the legal formalities before marriage, to set the framework for the spouses’ property relations. This differs from another type of agreement that arises during marriage.
2.0 Postnuptial Agreement: Property Arrangements Entered Into After Marriage
A postnuptial agreement is a property-related contract made between husband and wife while they are lawfully married, as provided in Section 1469 of the CCC. This type of agreement is more flexible than a prenuptial agreement because the law does not prescribe any specific form for it. At the same time, however, the law grants a special right to the spouses to rescind such an agreement, which distinguishes it from ordinary contracts.
2.1 Essential Features and the Right of Rescission
A postnuptial agreement covers all kinds of property arrangements between husband and wife—for example, contracts of sale, exchange, gifts between spouses, or even agreements to divide marital property while the marriage still subsists, which can result in the divided property changing into personal property of each spouse (Supreme Court Judgment No. 337/2530).
The key characteristic of a postnuptial agreement is the right of rescission under Section 1469, enacted to protect a spouse who may have entered into an agreement under the influence of affection and to their own detriment. The main points are:
- Who may rescind: Either the husband or the wife may rescind the agreement. This is a personal right and cannot be exercised by heirs (Supreme Court Judgment No. 890/2517).
- Time limit: The agreement may be rescinded at any time while the marriage still exists, or within one year from the termination of the marital status (e.g., the date of divorce registration or the death of one spouse).
- Effect of rescission: Once rescinded, the agreement ceases to be binding as if it had never existed. If property has already been transferred under the agreement, it must be returned to its original status.
- Exception: The rescission does not affect the rights of third parties who have acted in good faith.
2.2 Legal Issues in Supreme Court Precedents
Supreme Court precedents have clarified several important principles regarding postnuptial agreements:
- Clauses excluding the right of rescission are void: In Supreme Court Judgments Nos. 5974/2538 and 8739/2551, the Court held that any clause in a postnuptial agreement that prohibits the parties from exercising the right of rescission is void because it conflicts with Section 1469, which is a rule relating to public order.
- Protection of bona fide third parties: In Supreme Court Judgment No. 3185/2552, the Court reaffirmed that even if a postnuptial agreement is later rescinded, if the property has already been transferred to a third party acting in good faith before the rescission, the third party’s rights are not affected.
- Using a lawsuit to exercise the right of rescission: Supreme Court Judgment No. 3857/2562 involved a case where the plaintiff (husband) used his personal property to purchase land but had the defendant (wife) registered as co-owner. This was considered a postnuptial agreement granting co-ownership in personal property. The husband’s filing of a lawsuit while the marriage still subsisted was deemed an exercise of his right of rescission within the legal time limit.
It can thus be seen that the right of rescission is a special feature of postnuptial agreements reflecting the legislator’s intention to give special protection to spouses. However, understanding such agreements requires a foundational understanding of the two types of property between husband and wife: personal property and marital property.
3.0 Personal Property: The Individual Property of Each Spouse
Personal property is property owned exclusively by one spouse, over which that spouse has the sole power to manage—whether selling, transferring, encumbering, or subjecting it to any obligations—without needing the consent of the other spouse, as provided in Section 1473 of the CCC.
3.1 Types of Personal Property
Under Section 1471 of the CCC, personal property is divided into four main categories:
- Property owned before marriage (Section 1471(1))
All property of any kind owned by a spouse before the date of marriage registration is that spouse’s personal property, whether land, bank deposits, or other movable property. - Personal use items, clothing, and tools of trade (Section 1471(2))
Even if acquired during marriage, items used personally “according to social status” and tools “necessary” for a profession or occupation are deemed personal property. For example, a sewing machine for a tailor or dental instruments for a dentist may be personal property. However, a car used by the dentist to commute to the clinic may not be considered a necessary professional tool and is often treated as marital property. - Property acquired by inheritance or by gift (Section 1471(3))
Property acquired by a spouse during marriage through inheritance or by gift is personal property of that spouse. This also includes cases where one spouse transfers their share of marital property to the other—such property then becomes the recipient’s personal property (Supreme Court Judgment No. 337/2530). An exception is where the testator or donor expressly states in a written instrument that the property is to be marital property. - Engagement gifts (Section 1471(4))
Engagement gifts given by the man to the woman as proof of an intention to marry become the woman’s property upon delivery and constitute her personal property.
3.2 Transformation of Personal Property (Real Subrogation)
The law sets out the principle of real subrogation in Section 1472 of the CCC to deal with changes in the form of personal property. Under this principle, if personal property is sold, exchanged, or the money obtained from its sale is used to buy new property, the property or money thus acquired remains personal property.
In more complex situations—such as when personal property funds are mixed with marital property funds to purchase new property—the status of the new property depends on the proportion of contributions. If the personal property portion is greater, the new property tends to remain personal property; if the marital property contribution is greater, the new property will be regarded as marital property. For example, if the husband sells his personal house for 600,000 baht and adds 400,000 baht of marital property funds to build a new house worth 1,000,000 baht, the new house will be treated as his personal property because the majority of the funds came from personal property.
Case study – Supreme Court Judgment No. 145/2563:
The plaintiff used his personal property to purchase land and build a house on it during marriage. The Supreme Court held that the house thus constructed was the plaintiff’s personal property under the principle of real subrogation.
In summary, personal property is subject to the exclusive management of the owning spouse, which is fundamentally different from marital property, which is jointly owned.
4.0 Marital Property: Property Acquired Jointly During Marriage
Marital property is property acquired by spouses during the marriage, which the law presumes to be jointly owned by both spouses in equal shares. This concept is based on the view that marriage is an economic partnership, in which both parties contribute to building the family’s financial base.
4.1 Types of Marital Property and Legal Presumptions
Under Section 1474 of the CCC, marital property consists of three main categories:
- Property acquired during marriage (Section 1474(1))
This is the most common type of marital property and covers all kinds of income earned during marriage, such as salaries, bonuses, business profits, and even winnings from games of chance. - Property acquired by will or gift expressly designated as marital property (Section 1474(2))
This is an exception to the rule that property received by inheritance or by gift is personal property. If the testator or donor intends the property to belong to both spouses, this intention must be clearly stated in the will or written gift. - Fruits of personal property (Section 1474(3))
“Fruits” arising from personal property during marriage are deemed marital property. This includes natural fruits (e.g., fruits from trees, offspring of animals) and civil fruits (e.g., rent from a house, interest on deposits). For example, if the husband rents out a house that is his personal property, the rent received during marriage is marital property.
Furthermore, Section 1474 paragraph 2 lays down an important legal presumption: when there is doubt whether certain property is marital or personal property, it is presumed to be marital property, and the party who claims it is personal property bears the burden of proof.
4.2 Management of Marital Property
Management of marital property can be divided into two levels: ordinary management that either spouse may carry out alone, and important acts that require joint management.
- Acts that may be done by one spouse alone
Either husband or wife may manage marital property alone for ordinary matters that do not fall within the eight important juristic acts, such as leasing immovable property for no more than three years, selling ordinary movable property, using marital funds for everyday expenses, or investing in an activity that does not fall under the exceptions. - Acts requiring joint management (Section 1476)
The law requires the consent of the other spouse or joint action for the following eight important juristic acts:- Selling, exchanging, selling with right of redemption, hire-purchase, mortgaging, discharging a mortgage, or transferring mortgage rights in immovable property or movable property that can be mortgaged;
- Creating or extinguishing servitudes, rights of habitation, superficies, usufructs, or encumbrances over immovable property;
- Leasing immovable property for more than three years;
- Lending money;
- Making gifts (except gifts appropriate to the family’s social standing);
- Compromising a dispute;
- Submitting disputes to arbitration;
- Using property as security or guarantee to officials or the court.
4.3 Effects of Managing Marital Property Without Consent
If one spouse carries out any of the eight important juristic acts under Section 1476 alone, Section 1480 of the CCC provides that the other spouse may file a lawsuit requesting the court to revoke that juristic act. An important principle is that revocation must be of the entire act, not just the portion relating to the non-consenting spouse (Supreme Court Judgment No. 882/2518).
However, revocation is not allowed in the following situations:
- where the other spouse has already ratified the juristic act; or
- where the third party acted in good faith and for value at the time of the juristic act.
The time limits for bringing an action to revoke are:
- within one year from the date the spouse became aware of the cause for revocation; or
- within ten years from the date of the juristic act.
These rules on the management of marital property reflect a balance between flexibility in day-to-day property management and the need for cooperation and consent in matters that significantly affect the family’s financial status. This stands in clear contrast to the legal status of couples who live together without registering their marriage.
5.0 Property Between a Man and Woman Living Together Without Marriage
For a man and woman living together as husband and wife without registering their marriage, their status is not that of “husband and wife” under the CCC. Therefore, the legal rules of “personal property” and “marital property” cannot be directly applied to their property relations.
5.1 Applicable Legal Principles
In the absence of specific family-law provisions, property relations between cohabiting partners are governed by general legal principles:
- Property jointly acquired through joint efforts
Property acquired through joint capital, joint labor, or joint efforts during cohabitation is treated as jointly owned property or as property held in a partnership-like relationship. As a general rule, the law presumes that each party owns an equal share (one half each). - Property acquired solely by one party
A key difference from marital property is that property acquired solely by one party through their own skill, labor, or capital, without contribution from the other, is regarded as that party’s personal property and is not automatically treated as jointly owned as in the case of marital property.
5.2 Supreme Court Precedents
The Supreme Court has set important guidelines on division of property for couples who are not legally married:
- Co-ownership in equal shares:
Supreme Court Judgments Nos. 632/2493 and 2013/2523 held that property acquired through joint efforts of a man and woman living together as husband and wife is considered jointly owned, with each holding an equal share. - Property received by inheritance:
Supreme Court Judgment No. 515/2519 held that property received by one party through inheritance is not considered jointly acquired property. The other party therefore has no right to demand a share. - Application of co-ownership principles to same-sex couples:
Supreme Court Judgment No. 3725/2532 involved two women who lived together and jointly earned their living. The Court applied the principles of joint ownership to divide the property they had acquired together, demonstrating that these principles can be applied to relationships where persons jointly build up their economic status, even if they cannot legally marry.
Conclusion
In summary, Thai law has established a comprehensive system for property relations between husband and wife—from advance planning through prenuptial agreements, to a clear division between personal property and marital property with different management rules, and finally to the application of general legal principles to ensure fairness for couples who cohabit without registering their marriage. All of these mechanisms share the common goal of promoting stability and clarity in the management of property, which forms an essential foundation for the institution of the family.
- “สินส่วนตัว”(个人财产 / 特有财产):专属于一方配偶的财产;
- 使双方在财产范围、归属与管理上具有清晰的共识;
- 令日后财产处理有明确依据;
- 法律不要求特定形式(例如无须登记或附于婚姻登记簿);
- 买卖契约、交换契约;
- 赠与契约(配偶间相互赠与);
- 出售、转让、设定担保;
- 使其成为负担或债务的标的;
即使是在婚后取得,只要是:- 依其社会地位适当的“个人用品、服装、饰物”;
- 裁缝的缝纫机;
Real Subrogation)
- 若个人财产出资比例较高 → 新财产倾向被认定为个人财产;
这是最常见的共同财产形式,包括婚后产生的一切收入,如:- 工资、奖金;
- 营业利润;
婚姻存续期间由个人财产产生的“果实(ดอกผล)”,视为共同财产。包括:- 自然果实:如果树结的果实、家畜的幼崽等;
如对某项财产究竟属共同财产或个人财产存有疑问,应先推定为“夫妻共同财产”;
- 一般管理行为:任一配偶可单独为之;
- 将不动产出租不超过 3 年;
- 出售一般动产;
- 日常生活开支;
- 对不动产或可抵押之动产为:买卖、交换、赎买、租购、设定抵押、解除抵押或移转抵押权;
- 设立或消灭地役权、居住权、地上权、用益物权或其他不动产负担;
- 将不动产出租超过 3 年;
- 出借金钱;
- 赠与(除“与家庭身份地位相称”的合理赠与外);
- 和解、调解争议;
- 将争议提交仲裁;
- 另一方配偶已经对该行为追认(ให้สัตยาบัน);
- 自婚前可通过“婚前协议”进行预先规划;
- 于婚姻存续期间,以“个人财产(สินส่วนตัว)”与“夫妻共同财产(สินสมรส)”的清楚分类及各自不同的管理规则为基础;
