หลักการจากมาตรา 179 (สรุป)
สามารถแก้ไขได้ เช่น:
- แก้ไขจำนวนทุนทรัพย์ – เพิ่มหรือลด
- สละบางข้อหา หรือ เพิ่มเติมฟ้องเดิม
- ยกข้อโต้แย้งใหม่ หรือปรับเปลี่ยนข้ออ้างเดิม
แต่… ห้ามเสนอ “คำฟ้องใหม่” เพิ่มเติมหรือแย้งในภายหลัง
❌ หากไม่เกี่ยวข้องกับคำฟ้องเดิม “จนไม่สามารถรวมพิจารณาและตัดสินได้พร้อมกัน”
✅ ตัวอย่างที่ “แก้ไขได้”
🔸 ตัวอย่าง 1:
ฟ้องเรียกค่าเสียหาย 100,000 บาท ต่อมาแพทย์ประเมินว่าความเสียหายมากกว่านั้น
✅ ขอแก้ไขฟ้อง เพิ่มทุนทรัพย์เป็น 150,000 บาท — ได้ (ตามข้อ 1)
🔸 ตัวอย่าง 2:
ฟ้องจำเลยเรื่องละเมิดเรียกค่าเสียหาย แต่ลืมระบุความเสียหายทางจิตใจ
✅ ยื่นคำฟ้องเพิ่มเติมเพื่อเพิ่มข้อนั้น — ได้ (ตามข้อ 2)
🔸 ตัวอย่าง 3:
จำเลยยื่นคำให้การว่า “โจทก์ไม่มีสิทธิเรียกร้อง”
ต่อมาจำเลยทราบว่าการฟ้องขาดอายุความ
✅ ขอแก้ไขคำให้การ เพิ่มข้อโต้แย้งเรื่อง “ขาดอายุความ” — ได้ (ตามข้อ 3)

🔻 ตัวอย่าง 4:
โจทก์ฟ้องเรียกค่าเสียหายจากอุบัติเหตุรถชน
ต่อมาจะฟ้องอีกเรื่องว่า “จำเลยผิดสัญญาซื้อขายรถ”
❌ ฟ้องแย้งใหม่ไม่ได้ — เพราะ ไม่ใช่เรื่องเดียวกันกับฟ้องเดิม และ ไม่สามารถรวมพิจารณาได้โดยไม่เสียความเป็นธรรม

จำเลยยื่นคำฟ้องแย้งเรื่องที่ดินอีกแปลงหนึ่ง
❌ ไม่ได้ — ถ้าที่ดินนั้น ไม่เกี่ยวข้องกับข้อพิพาทในคดีเดิม

Section 179 – Amendment แก้ไข of Pleadings
This section allows either the plaintiff or the defendant to amend their claims, defenses, or arguments that were submitted in the original complaint or answer to the court — with limitations.
✅ Amendments Allowed:
Section 179 specifically permits amendments in the following cases:
- Increasing or decreasing the amount in dispute
➤ e.g. Value of the property or damages claimed - Withdrawing part of the original claims or adding to them
➤ via additional pleadings during the trial or for enforcement - Raising new defenses or modifying existing arguments
➤ to support or counter the other party’s claims
❌ What is NOT Allowed:
You cannot file a new complaint (whether additional or counterclaim) after filing the original one — unless the new claim is sufficiently related to the original claim so that both can be considered and decided together.
✅ Examples of What Is Allowed (Amendable):
🔸 Example 1:
Plaintiff originally sues for damages of 100,000 baht.
Later, a medical report shows greater injury.
✅ Plaintiff may increase the claim to 150,000 baht. (Allowed under (1))
🔸 Example 2:
Plaintiff forgot to claim emotional damages in the initial complaint.
✅ Plaintiff may submit an additional pleading to add that claim. (Allowed under (2))
🔸 Example 3:
Defendant initially claims the plaintiff has no right to sue.
Later discovers that the statute of limitations has expired.
✅ Defendant may amend the answer to include “expiration of limitation period.” (Allowed under (3))
❌ Examples of What Is NOT Allowed (Not Amendable):

Plaintiff sues for a traffic accident.
Later wants to sue for breach of a separate car sale agreement.
❌ Not allowed — because the new claim is unrelated and cannot be decided together.
